{"id":3800,"date":"2021-07-06T17:57:44","date_gmt":"2021-07-06T17:57:44","guid":{"rendered":"https:\/\/salinareport.com\/?p=3800"},"modified":"2021-07-06T17:57:44","modified_gmt":"2021-07-06T17:57:44","slug":"22-states-ask-supreme-court-to-uphold-second-amendment-after-series-of-bizarre-anti-gun-rulings","status":"publish","type":"post","link":"https:\/\/salinareport.com\/?p=3800","title":{"rendered":"22 States ask Supreme Court to uphold Second Amendment after series of bizarre Anti-Gun rulings"},"content":{"rendered":"<p data-reader-unique-id=\"2\">Medford, OR &#8211; Once upon a time, when the U.S. Supreme Court ruled on an issue, that was the final legal word on the matter.<\/p>\n<p data-reader-unique-id=\"8\">Apparently, not anymore.<\/p>\n<p data-reader-unique-id=\"9\">Times have become so partisan in America, even Supreme Court precedence doesn\u2019t matter to some lower federal courts, and that is especially true of the oft-overturned Ninth U.S. Circuit Court.<\/p>\n<p data-reader-unique-id=\"16\">Despite previous rulings on the matter by SCOTUS, Ninth Circuit courts have ruled that Hawaiians\u2019 Second Amendment rights don\u2019t extend beyond their personal residences, a goofy ruling that flies in the face of the landmark Supreme Court decision in 2008, <em data-reader-unique-id=\"17\">District of Columbia v. Heller.<\/em><\/p>\n<p data-reader-unique-id=\"18\">As noted by <a href=\"https:\/\/www.theepochtimes.com\/texas-joins-21-other-states-asking-supreme-court-demanding-protection-of-second-amendment_3887277.html\" data-reader-unique-id=\"19\">The Epoch Times<\/a>, nearly two dozen other states are now coming to the assistance of Hawaii residents, including from the deep-red state of Texas:<\/p>\n<p data-reader-unique-id=\"25\"><em data-reader-unique-id=\"26\">Texas joined 21 states asking the Supreme Court to uphold Hawaiians\u2019 Second Amendment rights<\/em> <em data-reader-unique-id=\"27\">to bear arms following a ruling from the Ninth Circuit Court of Appeals last year that upheld Hawaii\u2019s ban on residents bearing arms outside their homes.<\/em><\/p>\n<p data-reader-unique-id=\"28\"><em data-reader-unique-id=\"29\">The states filed an amicus brief with the high court to help resolve a split among the federal circuit courts of appeal after several of the courts ruled against the 2008 District of Columbia v. Heller case, a landmark gun-rights ruling.<\/em><\/p>\n<p data-reader-unique-id=\"30\">\u201cOne of the highest responsibilities of a state is to safeguard the rights of its citizens,\u201d the states wrote last week in their collective brief, \u201cincluding the right \u2018to keep and bear arms\u2019 under the Second Amendment.\u201d<\/p>\n<p data-reader-unique-id=\"31\">\u201cLaw-abiding citizens keep firearms for self-protection\u2014both inside and outside of their homes. Amici seek to ensure that their residents will not be deprived of their Second Amendment freedoms,\u201d the brief said, as states further argued that the Second Amendment right includes being able to carry and utilize firearms outside of homes.<\/p>\n<p data-reader-unique-id=\"32\">\u201cThe plain text of the Second Amendment protects the right to bear arms, not just to keep them,\u201d according to the brief. \u201cYet Hawaii\u2019s firearm carrying regulatory regime functions as an outright ban on the right to carry guns outside the home for most people. It therefore violates the Second Amendment.\u201d<\/p>\n<p data-reader-unique-id=\"33\">Following <em data-reader-unique-id=\"34\">District of Columbia v. Heller<\/em> and a 2010 SCOTUS ruling, <em data-reader-unique-id=\"35\">McDonald v. City of Chicago<\/em>, the brief said that \u201clower courts have applied inconsistent standards in Second Amendment challenges to state firearm restrictions.<\/p>\n<p data-reader-unique-id=\"36\">The states also point out that the First, Seventh, and D.C. circuit courts have all have ruled that the Second Amendment right to bear arms exists outside of homes. However, other appeals courts have issued rulings that are inconsistent with, or directly conflict with, that established precedent.<\/p>\n<p data-reader-unique-id=\"41\">\u201cInconsistent decisions by the lower federal courts have left States uncertain as to the precise boundary between permissible and impermissible restrictions,\u201d said the brief. \u201cThese inconsistencies have also prevented citizens of amici States from exercising their right to carry and bear arms across State lines.\u201d<\/p>\n<p data-reader-unique-id=\"42\">The Republican attorney general of Texas, Ken Paxton, said last week the Lone Star State would be joining the brief.<\/p>\n<p data-reader-unique-id=\"43\">\u201cThe blatant misinterpretation of the Second Amendment by the Ninth Circuit must be remedied,\u201d Attorney General Paxton said.<\/p>\n<p data-reader-unique-id=\"44\">\u201cWe are asking for the Court to simply uphold the Second Amendment as it is written. The lower courts have flagrantly disregarded the Supreme Court\u2019s instructions in Heller, leaving the right to bear arms in jeopardy,\u201d he added.<\/p>\n<p data-reader-unique-id=\"45\">\u201cWe must have a clear and concise ruling that protects the Second Amendment from lower courts\u2019 hostility to gun rights to prevent this type of infringement from happening yet again,\u201d he said.<\/p>\n<p data-reader-unique-id=\"46\">Again, we thought we had clear rulings on this issue.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Medford, OR &#8211; Once upon a time, when the U.S. Supreme Court ruled on an issue, that was the final legal word on the matter.
